License contract for Portello AB’s program product Portello™

READ THIS LICENSE CONTRACT BEFORE INSTALLING PORTELLO AB’S PROGRAM PRODUCT PORTELLO ™. BY INSTALLING PORTELLO AB’S PROGRAM PRODUCT PORTELLO ™, YOU AGREE TO BE AUTOMATICALLY BOUND BY THE CONDITIONS IN THIS LICENSE CONTRACT. IF YOU DO NOT AGREE TO THESE CONDITIONS, DO NOT INSTALL PORTELLO AB’S PROGRAM PRODUCT PORTELLO ™.
1. License. Portello AB’s program product Portello ™ is licensed to you by Portello AB. You own the media which Portello AB’s program product Portello™ is used on, but Portello AB holds all owner’s rights to Portello AB’s program product Portello™. Both Portello AB’s program product Portello™ and eventual copies, which you have the right to make according to this licensing contract, are regulated by this license contract.

2. Permission for use and restrictions. This license gives you the right to install and use Portello AB’s program product Portello™ on only one (1) computer. Portello AB’s program product Portello™ may only be used on the http// addresses or equivalent which your license covers. Http:// addresses or equivalent refer to electronic storage places for files. You do not have the legal right without a previously written contract to, in any way, change/increase/switch between more than one computer or between more than the http:// addresses or equivalent that are specifically referred to in your contract. You may make one (1) backup copy of Portello AB’s program product Portello™ in machine-readable form. This copy must reproduce all information regarding the copyright which exists on the original. The security copy may only be used on the condition that the original is no longer useable or in some way has stopped functioning; this will not be a breach of the licensing agreement. You are explicitly forbidden by this contract to decompile, deconstruct, break down, change, rent, lease, loan, sub-lease, distribute, or create a derived product wholly or partially based on Portello AB’s program product Portello™, or to transfer Portello AB’s program product Portello™ from one computer to another via a network. You may not transfer your rights to Portello AB’s program product Portello™. Your rights according to this licensing contract are automatic and Portello AB may, at any time and without notice, cancel your product if you deviate from the prescribed conditions in this License contract.

3. No guarantee for Portello AB’s program product Portello™. All use of Portello AB’s program product Portello™ is at your own risk. Portello AB’s program product Portello™ is distributed as-is and without any guarantees. Portello AB IS NOT RESPONSIBLE FOR ANY SPOKEN OR UNDERSTOOD GUARANTEES REGARDING THE QUALITY, FUNCTIONALITY, AND USE FOR ANY SPECIFIC PURPOSE. PORTELLO AB GIVES NO FURTHER GUARANTEES THAT PORTELLO AB’S PROGRAM PRODUCT PORTELLO™ DOES NOT INFRINGE ON OTHER IMMATERIAL RIGHTS. PORTELLO AB CANNOT EITHER GUARANTEE THAT PORTELLO AB’S PROGRAM PRODUCT PORTELLO™ WILL FULFILL YOUR EXPECTATIONS, IS FAULT-FREE, OR CAN BE USED WITHOUT BREAKING DOWN, OR THAT FAULTS AND SHORTAGES IN PORTELLO AB’S PROGRAM PRODUCT PORTELLO™ WILL BE ATTENDED TO. PORTELLO AB GIVES NO GUARANTEE REGARDING USE OR RESULT OF USING PORTELLO AB’S PROGRAM PRODUCT PORTELLO™ AND DOCUMENTATION, IT’S ACCESSORIES, RELIABILITY, OR OTHER QUALITIES. THIS LIMITED GUARANTEE CANNOT BE ALTERED VERBALLY OR IN WRITING FROM PORTELLO AB OR PORTELLO AB’S REPRESENTATIVES. IF PORTELLO AB’S PROGRAM PRODUCT PORTELLO™ SHOULD BE FAULTY OR HAVE MISSING COMPONENTS, PORTELLO AB IS NOT RESPONSIBLE FOR ANY DAMAGES, SERVICE, REPAIRS, OR OTHER RELATED COSTS. IN THE EVENT THAT THIS DECISION IS IN CONFLICT WITH RELEVANT LAW, THE DECISIONS IN THIS SECTION ARE NOT VALID. THIS DECLARATION SHALL NOT BE CONSIDERED AS LIMITING PORTELLO AB’S RESPONSIBILITY FOR PERSONAL INJURY DUE TO PORTELLO AB’S NEGLIGENCE.

4. Responsibility restrictions. PORTELLO AB IS NOT - UNDER ANY CIRCUMSTANCES - RESPONSIBLE FOR DAMAGES, EITHER DIRECTLY OR INDIRECTLY, CAUSED BY OR HAVING TO DO WITH THIS LICENSE. PORTELLO AB CAN UNDER NO CIRCUMSTANCES BE HELD RESPONSIBLE FOR ANY ARISING COSTS RELATED TO USE OF PORTELLO AB’S PROGRAM PRODUCT PORTELLO™, IRRESPECTIVE OF CAUSES FROM FAULTS OR SHORTAGES IN PORTELLO AB’S PROGRAM PRODUCT PORTELLO™ OR IN IT’S WRITTEN MANUAL, VERBAL SUPPORT, OR PHYSICAL INSTALLATION.
5. System requirements etc. PORTELLO AB’S PROGRAM PRODUCT PORTELLO’S™ FUNCTIONS ARE BASED ON CERTAIN SYSTEM REQUIREMENTS CONCERNING THE COMPUTER OR WORK STATION WHERE IT IS INSTALLED, AS WELL AS OTHER PROGRAM SOFTWARE IN THE LICENSEE’S COMPUTER OR WORKSTATION. IF THE LICENSEE CHANGES THIS, PORTELLO AB IS EXEMPTED FROM ALL RESPONSIBILITY REGARDING PORTELLO AB’S PROGRAM PRODUCT PORTELLO’S™ FUNCTIONALITY. PORTELLO AB ACCEPTS NO RESPONSIBILITY FOR ANY INTERFERENCE BY ANOTHER PARTY WHICH CAN CHANGE THE PRESUPPOSED PURPOSE FOR PORTELLO AB’S PROGRAM PRODUCT PORTELLO™ AND IT’S ABILITY TO FUNCTION AS INTENDED. WITH PROBLEMS CONCERNING ANOTHER PARTY’S PRODUCT, CONTACT THE ADMINISTRATOR, HELPDESK, OR EQUIVALENT OF THE ELECTRONIC STOREROOM OR EQUIVALENT WHICH PORTELLO AB’S PROGRAM PRODUCT PORTELLO™ IS TO COLLABORATE WITH. FURTHER CONCERNS REGARDING THE STANDARDS OF ANOTHER PARTY, PROGRAM, OR EQUIVALENT, WHICH PORTELLO AB’S PROGRAM PRODUCT PORTELLO™ IS COMPLETELY OR PARTIALLY DEPENDANT ON TO FUNCTION PROPERLY, SHOULD BE HANDLED LIKEWISE.
IT IS UNDERSTOOD THAT YOU CONTINUALLY KEEP YOURSELF INFORMED ON, AND INSTALL THE UPDATES FOR, PORTELLO AB’S PROGRAM PRODUCT PORTELLO™, AS PROVIDED BY PORTELLO AB ON THIS WEBSITE OR BY OTHER MEANS.

6. Retailers. Portello AB can authorize retailers of Portello AB’s program product Portello™. These authorized retailers cannot give guarantees or change the responsibilities as stipulated in this license contract. It is your obligation to ensure that the salesperson from whom you obtain Portello™ (in a physical locale, electronic or written media, personal contact, or otherwise) is a legitimate and authorized retailer of Portello AB’s program product Portello™. If Portello AB’s program product Portello™ is obtained in any other way than through Portello AB or an authorized Portello AB retailer, the purchaser has obtained Portello AB’s program product Portello™ illegally, and Portello AB has the right to take appropriate legal measures as provided for in the jurisdiction of the country where the purchase took place. Portello AB reserves the right to demand compensation and damages according to the laws of the respective country.

7. Export. You do not have the right to export - or to use a third party to export - Portello AB’s program product Portello™ in any way that is not approved by export laws in the country where Portello AB’s program product Portello™ is acquired.

8. Current and valid law. In this license contract, Swedish law applies. In the event that certain conditions in this license agreement are judged not valid or enforceable by a court or administrative authority, other parts of the contract shall remain fully in effect and are to be interpreted as valid just as if the excluded section of the contract were valid.

9. Complete contract. This license contract contains everything that is agreed upon between parties with the intention of using Portello AB’s program product Portello™ and Portello AB, and replaces earlier collective written or verbal contracts, promises, or agreements between the parties. Changes in this license agreement can only be made by specially authorized authority and by a legitimate representative for Portello AB in a signed document.
